The Forum: Citizens United v. FEC: Did The Court Get It Right? What Happens Next?

Last month the Supreme Court decided what may well be the most important decision of the Term (if not the Roberts Court thus far). In Citizens United, the justices invalidated a provision of the Bipartisan Campaign Reform Act which barred corporations from spending money on behalf of, or against, candidates for office. They also overturned their precedent in Austin v. Michigan Chamber of Commerce, which had allowed restrictions on corporate speech. Citizens United has been applauded in some quarters as a “free speech” decision, or for eliminating distinctions between corporations and individuals. It has been reviled in other quarters for the same reasons. Polls show unhappiness on both the left and the right. This Forum brings together a set of high-profile experts to talk about Citizens United: whether it was right or wrong as a matter of constitutional law, and what its ramifications will be for American politics? Will money now flow from corporate coffers into political races? Or will the decision mean less that it seems in the long run?

Panelists:

Floyd Abrams, Partner, Cahill Gordon & Reindel LLP

Samuel Issacharoff, Bonnie and Richard Reiss Professor of Constitutional Law, NYU School of Law

Monica Youn, Counsel in the Democracy Program of the Brennan Center for Justice at NYU School of Law

Reporting from San Francisco and Los Angeles — A federal judge declared California’s ban on same-sex marriage unconstitutional Wednesday, saying that no legitimate state interest justified treating gay and lesbian couples differently from others and that “moral disapproval” was not enough to save the voter-passed Proposition 8.

Is Obama Really a Cracker Hating, Communist?

As I voted for Barack Obama yesterday a stream of “what ifs” paraded through my mind:

What if he’s not a one man terrorist sleeper cell?

What if he’s really not a socio-communist who only lectured American Constitutional law for twelve years and served in the congress for over a decade as a cover for his real aims– recreating the smashing success of the Soviet Union?

What if, since he was raised much of his life by his white grandparents he wasn’t really a cracker hatin’ Negro who will finally be able to start the white holocaust?

What if he didn’t really want to start ripping live babies out of mother’s wombs and throwing them in dumpsters?

Could it be true? Surely these are reasonable concerns, that deserve our attention, right? Concerns raised by reasonable people based on reasonable solid factual evidence.

What if those concerns miraculously turn out to be unfounded hysterical propaganda? What then?

Will he implement all of the things he has campaigned on? Can I really be sure that he will be perfect?

What if he fails to be as perfect as George W, Bush? What if he only accomplishes seven in ten of those things, six, five, four? Would it still have been worth it to get in my car, wait in line and cast my vote?

To that I can only say- yes!

————————————-

CORRECTION: BARACK OBAMA’S EXPERIENCE:
*8 years as State Senator for district of over 750,000 people

*Chairman of Senate’s Health and Human Services committee
*Sponsored 136 bills,

AND:Listening to George W. Bush’s halted, sub-human mumble for NEARLY eight years, not more than. Sorry.
