How is the Obama/Reid/Pelosi health care bill going to get past constitutional law?

The government can not mandate people to buy health insurance with the Constitution written as it currently is. An amendment to the Constitution to rectify this is impossible. Lawsuits will be filed immediately if this bill is signed into law and it will be put on hold until legally defeated. Why would congress go through all this trouble for nothing?

I agree. Pelosi, Reid, Frank, Waxman, Murtha, Obama, Emanual, Lloyd, Sunstein, Sibelius – all of these corrupt politicians need to read the Constitution and abide by it or be thrown out of office and/or the country – after all they swore to uphold and protect the Constitution when they took office! What happened to that promise? And why is no one holding them to it?

The current administration is spending money more irresponsibly than ever before – maybe, just maybe they are actually trying to intentionally destroy this great country – solely for the purpose of accumulating massive power and control. This will not happen without violence and civil unrest by the tax payers – an outcome, if Obama stays in power, that I am afraid we are heading toward.

It is our duty as “We the People” to FORCE our politicians to once again revert back to the writings of the Constitution. Nothing our corrupt politicians are doing is following the Constitution. We must FORCE these out of touch politicians to once again govern our great country based on what the Constitution says they can do and what they have no business doing.

    Phil: Wrong. I wager a I know a lot more about the constitution than you (I actually have a copy sitting in front of me right now). Try reading up on the case law concerning the 10th amendment before making such baseless claims. If you happen to have access to legal research database, look up South Dakota v. Dole, 483 U.S. 203. Then get back to me, thanks.

    It will not be nothing. Lawsuits will be filed for sure. But by the time those lawsuits are rectified, if ever, there will be people already used to having it and it will be harder to take the health care away from those who would get it. So, it becomes inhumane to take it away and no politician wants to look inhumane. I’m sure Reuplicans would have done away with Medicare if they could have done it without looking like a bunch of jerks in an election year. Once the gov. provides a service, they pretty much have to keep it and Obama, Reid, and Pelosi know that.

    well- the majority of out country’s population not only voted for these idiots- but they also have not one single clue as to what their constitutional rights are if it doesn’t involve food stamps and porn. So it’ll probably pass because someone will wag a steak infront of their faces in return for a vote securing this legislation. No skin off their backs- they don’t work.

    Oh yeah and Harry Reid is the biggest peice of dog crap and anyone who listens to him in borderline mentally deficient.

    Well unfortunately the liberal activist Supreme Courts, whose only job is to decide on Constitutionality, have decided against the Constitution numerous times. I wouldn’t take it for granted that it would be different this time.

    It’s like the 10th Amendment doesn’t even exist.

    EDIT: You are not forced to buy auto insurance. You are allowed to not drive in this country, you know?

    State governments mandate that people buy automobile insurance and this has not been found unconstitutional. The federal government already mandates that people pay into the medicare program. This has not been found to be unconstitutional.

    The tenth amendment does NOT prohibit congress from passing health care legislation.

    There is no 28th amendment! The 27th was the last one ratified.

    They can mandate people to buy car insurance.

    The constitution does not forbid it, therefore, congress can pass any law it deems necessary.

    Learn a little about the constitution, don’t just repeat what you hear.

    Congress passed laws against alcohol,

    The health bill doesn’t force you to buy into it.You can choice not too.Just pay the fine.That way I’ll get some of the money back I’ve been paying ever time you’ve gone to the emergency room with no insurance.

    Thank you, John, for raising this. I’ve been asking this question from the beginning.

    The comparison to auto insurance is moot.. that is a state requirement, not a Federal one. I’m not sure who the last state that didn’t require it was.. but wasn’t that long ago. Arizona, I believe? Big difference. States have every right, by way of the 10th amendment, to legislate requirements such as this. Massachusetts already has a system much like they would like to implement. (And it’s failing miserably).

    The comparison to mediscare is also moot; as this is appropriately referred to as a ‘tax’, which is what it is. The requirement to purchase a private product as a condition of your citizenship is again, something completely different, and unprecedented in this nation. As is all of the privacy invasion that will go along with it. No privacy for your finances. No privacy for your body. Soon, no privacy in your own home. Welcome to 1984.

    We will not stand for it. We will not allow our country to be taken from us. This will be a battle of biblical proportions.

    This has nothing to do with healthcare, it has more to do with the goings-on in Copenhagen this week. It’s the end of a great nation, if we do not rise in one terrible voice and stop it.

    Legislators; 2010 is coming. You WILL be fired by your employers (citizens) if you do not responsibly do your job for THEM, not your lobbyist pimp daddies.

    The constitution does not matter. That statement sounds crazy, but it’s true. Many of the Dems have been asked how they are justifying this in the constitution. None of them have an answer. All Pelosi could come up with was "Are you serious?" There are many others. Just Google "health care constitution questions" or "health care constitution where" and have a field day.

    The tenth amendment has been ignored for longer than a century already. Almost any part of the constitution can be circumvented by bending the meaning of other parts. They do it all the time, especially when judges legislate from the bench. It is just a fact that the constitution no longer really means anything. With nobody enforcing it upon our politicians, it will continue to be that way.
